1. Acceptance of Terms

By accessing and using the Tesla Inc website, dashboard, investment products, and all related services (the "Platform"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately cease using the Platform and close your account.

2. Account Registration & Responsibility

You must provide accurate, current, and complete information during the registration process. You are fully responsible for all activities that occur under your account. You must be at least 18 years of age, may not use the Platform from prohibited jurisdictions, and are limited to one account per individual.

3. Account Security

You are solely responsible for maintaining the confidentiality of your login credentials, two-factor authentication codes, and any other authentication methods. Tesla Inc employs industry-standard security measures; however, you acknowledge that no system is completely immune to unauthorized access. You agree to immediately notify us of any unauthorized use of your account.

4. Investment Products & Risks

All investment products offered on this Platform carry inherent risk. Projected returns and AI-generated yield estimates are based on historical models and market simulations — they are not guarantees of future performance. The value of investments can go down as well as up, and you may lose some or all of your invested capital.

Tesla Inc is not a registered broker-dealer, investment adviser, or financial institution. Nothing on this Platform constitutes financial advice or a solicitation to buy or sell any security. You should consult with a qualified financial professional before making investment decisions.

5. No Guarantees of Returns

Any historical data, performance metrics, or projected yields displayed on the Platform are for informational purposes only. Past performance does not guarantee future results. Market conditions, volatility, and external factors can materially affect investment outcomes. You acknowledge that you are investing at your own risk.

6. KYC, AML & Regulatory Compliance

To comply with applicable laws and regulations, including Anti-Money Laundering (AML) and Know Your Customer (KYC) requirements, we may request identity verification documents. Failure to provide requested documentation may result in account restrictions, delayed withdrawals, or account suspension.

7. Deposits & Withdrawals

Transaction fees vary by payment method and are displayed before confirmation. Withdrawals are processed within 1-3 business days for verified accounts. We reserve the right to delay or deny withdrawals if suspicious activity is detected, KYC verification is incomplete, or the withdrawal amount exceeds your available balance. Minimum withdrawal amounts apply and vary by payment method.

8. Fees, Charges & Taxes

Deposit and withdrawal fees are clearly displayed before you confirm any transaction. You are solely responsible for reporting and paying any applicable taxes arising from your use of the Platform. Tesla Inc does not provide tax advice.

9. Third-Party Services & External Platforms

The Platform may contain links to third-party websites, exchanges, or services. Tesla Inc does not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and the third party. Tesla Inc is not responsible for any losses incurred through external platforms, including cryptocurrency exchanges, social media groups, or messaging applications.

10. Fraud Prevention & User Awareness

You acknowledge and agree that Tesla Inc will never contact you asking for your password, two-factor authentication codes, private keys, or funds. If you receive any such request through any channel — including email, phone, social media, or messaging apps — it is fraudulent and should be reported immediately.

You are responsible for verifying the authenticity of any communication claiming to be from Tesla Inc. Official communications will only come from verified email addresses ending in @teslainc.com and through the in-app notification system.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESLA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Without limiting the foregoing, Tesla Inc shall not be held liable for losses resulting from:

• Unauthorized access to your account due to your failure to secure your credentials
• Phishing attacks, social engineering, or impersonation by third parties
• Fraudulent schemes conducted outside the official Platform
• Market volatility, trading losses, or investment underperformance
• Technical issues, network congestion, or blockchain-related delays
• Force majeure events including natural disasters, cyber attacks, or government actions

12. Intellectual Property

All content, trademarks, logos, software, and intellectual property on this Platform are owned by or licensed to Tesla Inc. You may not copy, reproduce, distribute, or create derivative works without express written permission.

13. Account Termination

We reserve the right, at our sole discretion, to suspend or permanently terminate your account without prior notice if you violate these Terms, engage in fraudulent or illegal activity, attempt to manipulate the Platform, abuse promotions, harass other users, or for any other reason deemed necessary to protect the integrity of the Platform and its users.

14. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein.

15. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the laws of the State of California, United States of America. You waive your right to participate in class action lawsuits against Tesla Inc. All claims must be brought individually, not as a plaintiff or class member in any class or representative proceeding.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
